General conditions of sale
Overview
The present conditions of sale apply to all products offered by ARC ATRIUM on its website www.arcatrium.com. The buyer recognizes that our general conditions predominate in case of litigation.
1 - Orders
All orders are submitted without reservation to our conditions of sale, which are applicable when the purchase order is issued or on collection of the merchandise directly by the client, accompanied by the signing of a delivery note issued by ARC ATRIUM.
2 - Catalogue and Documentation
The prices and technical information described in our catalogues, tariffs, documentation and brochures are only an indication and are without any commitment on our part. They will not commit us in any way and we reserve the right to modify them at any time.
3 - Prices
Our prices include all taxes, from our warehouse, shipping not included.
4 - Delay of retraction
For all orders made on our website, the buyer has 7 days from the delivery date to retract the order. He will then return the accessories as new and unused (no trace of wear and tear) and/or the other products unopened and unmodified (weight, colour) at his own expense. The goods must be returned in their original packing (box and accessories) accompanied by the receipt of purchase. On receipt and after verification of the good state of the products, we will issue a credit note or we will refund the price of the order whichever the client chooses.
5 – Complaints
The transportation is at the risk and hazard of the recipient, the buyer must make all the necessary verifications when receiving the goods in the presence of the transporter, in order to exercise, if necessary and within the regulatory delay, any recourse against the transporter.
6 –Payment
The buyer can pay by bank card, cheque, cash on delivery (with fees), bank transfer, swift transfer or money order, the initial payment of the order is after the acceptance of the offer of sale by ARC ATRIUM, in the conditions above and considering his right of retraction. The order made by the buyer will only be recorded from the date on which the total payment has been received by the seller. In the case of unlawful or non conform payment, whatever the reason may be, ARC ATRIUM reserves the right to stop delivery of the goods ordered.
7 –Delivery
The goods ordered are delivered by post or by delivery company according to their nature and at the exclusive initiative of the seller, to the address indicated on the order by the buyer. The delivery charges are charged totally to the buyer. In case of damage, the buyer must make a complaint as explained in paragraph 4.
8 - Litigation and reservation of title
In the absence of an amicable agreement, the litigation relative to the orders made according to the present offer is in all cases, and regardless of the number of parties in litigation, under the responsibility of the Tribunal of Commerce in Avignon. The fact for the seller not to prevail himself of a breach in any of the obligations of the buyer, regulated by these conditions of sale, cannot be interpreted as forgoing in the future the concerned obligation or the right for the buyer to prevail himself of this breach.
Reservations and Property : Law 80-335 of 12th May 1980. The goods remain the property of the seller until total payment is made, even in case of liquidation of assets, court proceedings or transfer of responsibility.
